1.1 These Terms of Trade (“Terms”) apply to all transactions made with DOF Reality (“the Company”).
2.1 These Terms, together with any written quotations, offers, or order confirmations, constitute the complete contractual basis for the Company’s sale and delivery of products, spare parts, and related services to the customer (“Contractual Basis”). Any customer purchasing terms shall be invalid unless expressly confirmed in writing by the Company.
2.2 Any modifications or additions to the Contractual Basis must be agreed to in writing to be valid.
3.1 All products and spare parts sold by the Company are new and subject to applicable legal standards.
3.2 Customer support services provided outside the warranty are also subject to applicable legal standards.
3.3 Products, spare parts, and services are intended solely for private entertainment use. The Company assumes no responsibility for any loss, damage, or injury resulting from commercial, industrial, or unintended use.
3.4 A Sim Racing Studio Standard License is included with each platform purchase. Premium features or upgrades must be purchased separately by the customer directly from Sim Racing Studio.
3.5 The SRS license includes only those features available at the time of purchase. Additional SRS software features may require future payments.
3.6 DOF Reality and Sim Racing Studio reserve the right to change pricing for goods and services at any time without notice or liability.
3.7 Neither DOF Reality nor Sim Racing Studio is responsible for inaccurate or missing game telemetry that may affect motion performance.
3.8 Customer contact information (name, address, email) may be used for product safety notices, recalls, technical updates, promotions, and support-related communications.
4.1 Pricing is determined by the Company’s price list valid at the time of order confirmation unless otherwise agreed in writing. Prices exclude VAT, customs duty, import taxes, and other local charges.
4.2 The customer is responsible for all import duties, taxes, customs fees, and brokerage charges in accordance with local law.
4.3 Customized products require upfront payment before production begins. Production and lead times apply to all non–pre-order products unless otherwise stated. Funds must be received within 5 business days to retain the production queue position.
4.4 Website discounts and promotions are valid only during the active promotional period and cannot be applied retroactively.
4.5 Only one discount or promo code may be used per order.
4.6 Promotions may be modified or cancelled at any time without notice.
4.7 All transactions are processed in USD. Local currency amounts displayed are estimates only, and the Company is not responsible for exchange rate variations.
5.1 Refunds are only permitted when a product is defective and cannot be restored after reasonable troubleshooting and potential repairs or parts replacement.
Refunds are not provided for buyer’s remorse or dissatisfaction unrelated to manufacturing defects.
Return shipping is the responsibility of the customer, who must package the product securely.
5.2 If a refund is approved, it will be issued within 20 days of receiving and inspecting the returned product, using the original payment method unless otherwise agreed.
6.1 Late payments or reversed transactions will accrue 1% interest per month on outstanding balances.
6.2 If payment is not made within 14 days of written notice, the Company may:
Retain upfront payments if production has started
Stop or withhold shipment
Cancel pending orders
Offset outstanding balances using goods in possession
7.1 Quotations are valid for 10 days unless otherwise stated.
7.2 Orders must include correct product details, part numbers, quantities, pricing, and payment terms.
7.3 Orders are not binding until written confirmation is issued by the Company.
7.4 Non-customized products and spare parts may be cancelled within 14 days of order confirmation. Customized products and services are non-cancelable.
7.5 Conflicts between an order and the confirmation must be reported within 2 business days or the confirmation prevails.
8.1 Pre-orders require either a down payment or full payment.
8.2 Down payment terms vary by product and offer.
8.3 Remaining balance is due once production begins.
8.4 Delivery estimates apply only after production starts and may vary.
8.5 Down payments are non-refundable and cannot be exchanged. If production has commenced, the order cannot be cancelled.
9.1 Deliveries are made under DAP Incoterms® (Delivered at Place), except platform shipments into EU member states. Customers assume responsibility for import clearance, duties, taxes, and customs risks.
9.2 Delivery shall follow the timeline stated in the order confirmation. Early delivery may occur.
9.3 Pre-order delivery dates remain estimates until production begins.
9.4 Customers must inspect goods upon receipt and report issues without delay in writing.
9.5 Website shipping rates are estimates and may change. The customer may be required to pay differences before shipment or receive a refund.
10.1 The Company will communicate expected delays promptly and provide updated delivery dates.
10.2 If delivery is delayed more than 30 days beyond the agreed date, the customer may cancel the delayed order for a full refund of payments made.
11.1 Warranty coverage lasts 12 months from delivery; replaced parts carry 6 months coverage.
11.2 Warranty excludes normal wear and tear, improper installation, misuse, unauthorized repairs, and external conditions. Up to 10% gearbox/arm movement play is considered normal.
11.3 Warranty claims must be submitted promptly in writing, including requested diagnostics.
11.4 The Company will investigate warranty claims within a reasonable time.
11.5 Remedies include replacement, repair, remote troubleshooting, or parts supply.
11.6 If the Company fails to resolve a covered defect, the customer may cancel the affected order for a refund.
11.7 H-series and M-series consumer models are not intended for commercial use. Warranty becomes void if used commercially.
Professional units follow the same structure and limitations as Section 11, with the addition that a technician may be dispatched if deemed necessary.
Software support is not included unless otherwise specified.
13.1 Extended warranty options are available as a paid upgrade.
13.2 Extended service plans for hardware and software can be purchased separately.
14.1 Each party is liable for its own actions under Wyoming law, subject to these Terms.
14.2 The Company’s product responsibility extends only to the delivered goods. The customer must assist in diagnostics and part exchanges as required.
14.3 In any calendar year, maximum liability is limited to 50% of the total invoiced amount to the customer for the prior year, except in cases of intent or gross negligence.
14.4 The Company is not liable for indirect or consequential losses.
14.5 Force majeure events suspend obligations for their duration.
15.1 All intellectual property rights remain the exclusive property of the Company.
15.2 If a product infringes a third-party right, the Company shall remedy at its own cost through licensing, modification, replacement, or buy-back (minus depreciation).
Under no circumstances will the Company or its service providers be liable for loss of use, production, profits, economic loss, indirect or consequential damages, personal injury, or punitive damages related to the use of DOF Reality hardware/software or the Website, regardless of negligence.
Total liability to the customer shall not exceed the lesser of:
$25 USD, or
The amount paid by the customer for the hardware involved in the claim.
You may return most new, unopened items within 30 days of delivery for a full refund. We'll also pay the return shipping costs if the return is a result of our error (you received an incorrect or defective item, etc.).
You should expect to receive your refund within four weeks of giving your package to the return shipper, however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days).
If you need to return an item, simply login to your account, view the order using the "Complete Orders" link under the My Account menu and click the Return Item(s) button. We'll notify you via e-mail of your refund once we've received and processed the returned item.
We can ship to virtually any address in the world. Note that there are restrictions on some products, and some products cannot be shipped to international destinations.
When you place an order, we will estimate shipping and delivery dates for you based on the availability of your items and the shipping options you choose. Depending on the shipping provider you choose, shipping date estimates may appear on the shipping quotes page.
Please also note that the shipping rates for many items we sell are weight-based. The weight of any such item can be found on its detail page. To reflect the policies of the shipping companies we use, all weights will be rounded up to the next full pound.
